House Bill 28 and Senate Bill 3 don’t just threaten Texas — they set a dangerous precedent for the entire country.
Every state ban chips away at national access to hemp. When one state targets hemp instead of enforcing smart, balanced regulation, it sends a signal to others — and to federal lawmakers.
The upcoming 2025 Farm Bill will evaluate how states are handling hemp. If bans keep piling up, we risk losing access to plant medicine nationwide, including THCa, full-spectrum CBD, Delta 9 edibles, vapes, and tinctures.

We have the power to beat these terribly written bill's, one which is endorsed and being pushed by the alcohol industry, which wants to put hemp out of business but keep THC beverages for themselves.
We have to let State Affairs House members who want to be re-elected know this will impact that. That we don't want them to vote in favor of this bill and that it is against the constituents best interest for maintaining access.
If they believe voters won't re-elect them they will support!
The Texas hemp industry is under attack.
Two proposed bills—HB28 and SB3—threaten to wipe out thousands of jobs, cut off access to natural wellness products, and hand control of hemp over to the alcohol industry.
We’re not against regulation—we want smart, science-based regulation. But these bills are not that.
What Are HB28 and SB3?
👉 HB28 (Rep. Ken King) and SB3 (Sen. Charles Perry) propose extreme changes to the way Texas regulates hemp-derived cannabinoids.
👉 These bills would ban nearly all products as they are today crippling the industry & putting it out of business. This includes crazy bans on wellness items like full-spectrum tinctures! It includes gummies.
👉 These bills ignore the existing regulations already enforced by the Texas Department of State Health Services (DSHS) and vilify safe, plant-based cannabinoids.

Key Talking Points 🧠
👉 If you're a Mom, Veteran, Republican, Christian, conservative, someone who has had wellness benefits, or know someone who has- these are key points to mention as these address some of the demographics of people they are concerned with supporting.
👉 The ban comes from fear tactics that kids are being sold these products and that these products cause people to overdose. This is ridiculous. Speak to that.
👉 They say we are unregulated. The reality is that current regulations are not being enforced. DSHS regulates and requires product safety testing, registration, manufacturing standards, child-proof packaging, and age restrictions. Tax the industry fairly to fund enforcement (they say they don't have money to enforce).
👉 These bills will eliminate access to cost-effective, shippable full-spectrum and therapeutic products that veterans, seniors, and people with serious medical needs rely on. Many of these people have restricted budgets and limitations on transportation that these products overcome.
👉 53,000+ jobs, $5 billion in economic value, and $238+ million in tax revenue are at stake. This ban would force people to buy online from out of state and wouldn't stop the products but would disable revenue going to Texas.
👉 They're saying these products are as bad as spice & bath salts!?! The compounds in these products (including Delta 8 and CBN) currently exist naturally in the plant and are widely regarded for their therapeutic potential. This is an outright lie to scare/confuse voters.
👉 We want smart regulation, not industry-killing bans & limitations. Alcohol wasn’t banned or told to limit potency to 2% so why are they suggesting that for therapeutic hemp? It will make it useless for wellness needs, especially by taking away gummies and tinctures, most often consumed by those in need.
👉 This product is on every corner (their own words) for a reason- it's because their voters want it. So they need to listen! They work for voters. Constituents want access, not prohibition. Polls and the proliferation of products prove it. 70% of Texans are in favor of plant medicine. Lawmakers who ignore this are not listening and will not be re-elected.

Contact the House State Affairs Committee and urge them to vote NO on HB28 and SB3. Tell them the country is watching—and we will not support banning nature while favoring Big Alcohol and allowing this to trickle to other states as it will.
