A USDA lawyer clarified the distinction between legal, less than .3% THC, industrial hemp, and hot hemp as illegal marijuana. Mentioning “a little bit of leeway” in terms of a lab’s margin of error, producers were encouraged to not negligently grow, as they could lose eligibility to participate in the hemp program.
